He said they will take my disability case. YEAH.

I have some paper work he wants me to have some of the drs to fill out, but some of the questions, i am not sure some will know the answer to. My pcp will have no trouble answering the questions about my ability to work for so many hrs, and whether or not i use a wheelchair, etc. But others would not. My neuro only knows how the strokes effected me, not the fibro, and so forth. A little worried on that part.

I had been sent a intake packet and since it did not have enough room for my drs and meds, i printed out my own paperwork. He was impressed and said i was extremely organized which helped.

My advice to anyone who has to talk with lawyer about appeal. Make sure you are prepared. I have insurance through dh's work. So i went to their website and got dr names and dates i saw them. Then looked up addresses and phones. I have to keep track of any new appts i have.

Also, he said my ankle problem (which ss rep said could not count since it started in 1983) would be considered. Esp since ss said themselves it made me disabled several years ago. I just have an idiot for a rep. He did say it could be 2 years before we get a final answer. That was the most. I pay him 25% of back pay and also any costs that are incurred getting medical records. He said there is no longer a cap what drs can charge for that. I have to pay the records cost no matter if i win or not.

Not bad for all the help though.

I'm so glad you went to the atty. If they tell you they will take the case, they feel you will get it. I had applied for SSD in 2008, didn't get it till 2011. I got the rejection letter and then I brought it to my atty. I had copies of almost every test I had done, but they had to get records from drs. I had to pay the cost of getting the records, too. They cost me about $13 per record.

My DH also applied for SSD. His company didn't give him a hard time, but the LTD ins company sure did. Our drs were not much help, not one wanted to put down that either of us were disabled.

I spoke w/ my atty re my DH, told him the prob he was having on all fronts. He told me to bring my DH in and he would help him. I brought him in and the atty was fantastic. My DH has sooo many health issues there should have been no problem w/ getting SSD. LTD company wasn't going to give an inch. The atty fought for us, before and after my DH won his case.

I have always been an organized person. Have I got files!! lol  But while all this was going on, I had a lot of other things going on. My DM was very sick, hassles w/ my sibs, my own crazy conditions, DH was in the hosp for various serious problems, my DMs passing. There was too much going on to fight it alone. Getting a lawyer was my absolute best decision.

I am happy when I hear that ppl win w/o an atty, but if you get a rejection letter or various hassles, get an atty. It will cost you a bit in money, but save yoou a world of sanity. Worth it in the long run.

People don't realize just because you pay into long term insurance means your going to get it. I had one company that it happen to me. This last company I worked for I was ready to fight the battle. They are tough and they try ever way not to pay you. You pay into it for years and find out they won't give it to you. I have been blessed because I still get it after 3 years. It takes lots of documentation and seeing Dr's frequent.

Good luck lady with your case. Maybe you won't have to wait long. I had to wait 9 months wimthout a lawyer.

Yep, your rep is an idiot.  My Crohn's disease counted and I've had that nearly all my life.  It kicked in big time in 1977.  My hearing loss counted and I lost that in 1992.  My fibro counted and that started in 1987.  He's an idiot. 

 

With all your problems and the stroke, etc.,  I am so surprised that you are having to get a lawyer to get disability.  They must have really tightened up the rules.  All my doctors had to do was send my records to SS.  I'm the one that had to fill out paperwork.  I don't think my doctors got any but am not sure. 

 

I'll be praying that you do get this...and get is soon.  You definitely deserve the disability with all the problems you have.

when i told the atty what the rep said about the ankle he started shaking his head. I had to cancel one appt that ssi had scheduled for me. I was scheduled for Nov 1 and the sunday before that was admitted to the hospital with pnuemonia and sepsis. When dh called to tell the rep, he was not in the office (that has happened 3 times when i had questions) dh asked for the supervisor who told him that was ok but for me to call when i got home. I called on that monday (i got out of hosp on nov 1 but about 7pm). the rep said he would reschedule i adv him that i had been in hospital and that i had another dr appt coming up. he said he would ask for hosp records but that anytime i had any other dr appts and told him about them it would make my decision take longer and to remember that.

when i told the lawyer that he put his head down on the desk saying wow. I went to the dr several times since and the insurance ok'd an electric wheelchair after that.

Some people you just want to shake because while i know they hear it all in a job like that, there is such a thing as being nice.

I also had to type additional pages to give them enough information. One cannot just put enough information in when they only put two lines down and ask "How have your conditions _____ and injuries" affected your ability to work?" (I can't remember the exact question. That is just so frustrating!

I hope your lawyer does help.
