Health codes are different for each state. I KNOW in California that you can be liable for lots if you intentionally sell a house knowing that there is toxic mold.
I know that mold grows on "something" and it is easily airborne. You can try and suck the mold out of the air, but until you do the remediation to the source, it will be a losing battle.
Sorry I don't know much more than that. I watched a family move into a black mold home and they all got ill. This house was a rental. The owners had to put the family up in a hotel while the house was under remediation and pay for dry cleaning of ALL the clothes, linens, their mattresses, etc. The family got out of the lease of the rental and got their things cleaned, but it had to cost the owners a lot of money.
